The overlay claims, the demand letters, and what actually holds up.
I received an ADA demand letter for my website. What should I do?
Do not ignore it. Run a free accessibility scan to see what issues exist, then document that you are actively remediating them. Courts look favorably on demonstrated good-faith effort. Kat ADA fixes the issues in your Squarespace source and provides a dated WCAG 2.1 AA report you can use as documentation of remediation. No tool or report can guarantee an outcome or prevent a lawsuit, and this is not legal advice.
Will an accessibility overlay protect me from an ADA lawsuit?
No. Overlay widgets add a script on top of your site without changing the code underneath, and courts, disabled users, and accessibility experts have consistently found that they do not make a site accessible. Regulators have taken the same view. In 2025 the US Federal Trade Commission settled a case that barred an overlay vendor from claiming its automated tool could make any website fully WCAG accessible. Automated tooling is genuinely useful for finding issues, and we use it too, but it cannot fix your source or guarantee conformance on its own.
Can I still get sued if I already have an overlay installed?
Yes, and the overlay can be part of why you were found. Installing a widget is a visible signal that you knew about accessibility and chose a patch on top instead of fixing the code underneath, and people who file these claims at volume look for exactly that. Courts have consistently rejected overlay widgets as evidence of WCAG conformance, and small businesses have been sued after buying one, in some cases finding that the legal support they were promised did not materialize. Fixing the real source is what addresses the barriers a tester actually runs into.
Does Squarespace make my website ADA accessible automatically?
No. Squarespace provides some built-in accessibility tools, including semantic HTML, alt text fields, and color contrast controls, but does not guarantee WCAG 2.1 AA conformance out of the box. Small businesses on Squarespace still need specialist fixes for issues like missing form labels, inaccessible buttons, poor focus indicators, and keyboard navigation gaps.
